Amplified Noise Ordinance

RE: Amplified Noise Ordinance

The Hamlin Township's Regulatory Ordinance #57 was adopted on July 11, 2024 by the Hamlin Township Board of Trustees and went into effect on August 24, 2024. Ordinance #57 is "An ordinance to secure the peace, safety, and welfare of the residents of Hamlin Township, Mason County, Michigan, by the control of amplified noise and sounds; to provide definitions for words and phrases; to declare the hours during which outdoor amplified sounds may be played or broadcasted; to provide penalties for violations; and for other related purposes."

Hamlin Township does recognize that property owners use amplified music and sounds for entertainment purposes. Per Hamlin Township Ordinance #57, a Special Permit will be required to conduct such events. The Hamlin Township Board of Trustees has approved that one Special Permit may be granted with respect to activities on the same parcel of real property in any given calendar year at no charge. In addition to the one approved Special Permit, twenty-nine (29) additional Special Permits for activities on a particular parcel can be applied for that require a fee of $200.00 for each permit. See Section 6 of the Ordinance.

Hamlin Township Ordinance #57, Section 7 states that "The provisions of this ordinance shall be applicable to all persons present within the township and all owners and occupants of real property within the township, even if the regulated use, production, amplification, dissemination, or broadcasting of amplified noise by that person or upon that person’s property commenced before the effective date of this ordinance".

Prohibited Activities: Please refer to Section 4 of the Ordinance. In summary, if any property owner applicable to Hamlin Township Ordinance #57 has or will be scheduling an event that may have amplified noise after 14 days of this letter, Hamlin Township requests a Special Permit application be completed and submitted. The application is to be delivered to the Hamlin Township Supervisor no less than 30 days prior to the requested date. For your convenience, I have included the Special Permit application form with this correspondence.
